Please read these Terms of Service carefully before browsing or purchasing from keithwahlart.com. By accessing this website or placing an order, you agree to be bound by these terms. If you do not agree, please do not use this site.

1. Introduction & Acceptance of Terms

1.1 Agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you ("buyer," "customer," or "you") and Keith Wahl Art, owned and operated by Keith Wahl, an independent artist based in Las Vegas, Nevada ("Keith Wahl Art," "we," "us," or "our"). These Terms govern your access to and use of the website located at keithwahlart.com (the "Site"), as well as any purchases made through the Site.

1.2 Acceptance. By accessing the Site, browsing its content, creating an account, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you are making a purchase on behalf of another person or organization, you represent that you have the authority to bind that party to these Terms.

1.3 Effective Date. These Terms are effective as of October 4, 2026 and supersede any prior agreements or understandings between you and Keith Wahl Art.

1.4 Eligibility. You must be at least 18 years of age, or have the verifiable consent of a parent or legal guardian, to make purchases through this Site. By using the Site, you represent and warrant that you meet this requirement.

2. Products & Services

2.1 About the Artist. Keith Wahl creates the source artwork personally. Original paintings and commissions are hand-painted; prints and Printful merchandise reproduce that artwork and are not themselves hand-painted originals. Keith Wahl is the sole creator and copyright owner of all original artwork he produces. Please note that where Keith Wahl Art offers fan art or artwork depicting characters, franchises, or properties owned by third parties, Keith Wahl does not claim ownership of the underlying intellectual property — such works are created as fan expressions and are not authorised, sponsored, or endorsed by the relevant IP holders (see Section 8). Merchandise items (such as print-on-demand products and branded apparel) are produced and fulfilled by Printful, Inc., a third-party print-on-demand service. While Printful handles the physical production and fulfillment of such merchandise, all artwork applied to these products is original work created exclusively by Keith Wahl.

2.2 Merchandise — Printful Production & Fulfillment. Merchandise items available in the shop (including but not limited to print-on-demand art prints, apparel, and other branded products) are printed and fulfilled by Printful. The following terms apply specifically to merchandise orders:

● Production times for merchandise are typically 2–7 business days before shipment, in addition to standard shipping transit times.

● Please contact theartist@keithwahlart.com promptly if you need to cancel or change a merchandise order. Changes or cancellations may be possible before fulfillment begins, but cannot be guaranteed. Once fulfillment has begun, the order can no longer be changed or cancelled through Printful. This does not limit any statutory rights you may have under applicable law.

● Returns or exchanges for merchandise are accepted only in cases of defective or damaged items, or incorrect items received due to a production or fulfillment error. To initiate a claim, customers must contact Keith Wahl Art at theartist@keithwahlart.com within 15 days of the date of delivery with clear photographs documenting the issue. This reporting window does not limit any statutory rights customers may have under applicable law. For packages lost in transit, customers should notify Keith Wahl Art within 15 days of the estimated delivery date so that we can investigate and submit any eligible supplier claim to Printful within its 30-day deadline. This reporting window does not limit any statutory rights customers may have under applicable law. Items do not need to be returned to initiate a defect or damage claim — a clear photo of the issue is sufficient. Eligible claims are assessed in accordance with Printful's defect and damage policy.

● Size exchanges are not available as a straight exchange. However, if a customer wishes to receive a different size, Keith Wahl Art may, at its discretion, place a new order at the customer's expense. Customers are strongly encouraged to consult the size guide in each product listing before ordering.

● Keith Wahl Art's obligations to customers regarding defective or damaged merchandise are independent of Printful's internal claim decisions. If Printful does not approve a supplier claim, that does not necessarily extinguish Keith Wahl Art's obligations under applicable consumer protection law. Customers with unresolved issues are encouraged to contact theartist@keithwahlart.com.

2.3 Original Artwork. Keith Wahl Art offers hand-painted original canvas panel paintings created using acrylic markers. Each original is a one-of-a-kind work of art — meaning no two pieces are identical, and the original painting itself will never be re-painted or duplicated. Once an original is sold, the physical artwork transfers to the buyer; however, Keith Wahl Art retains archival records, photographs, and digital references of all sold works for portfolio, documentation, and business purposes. The buyer acquires ownership of the physical original but does not acquire any reproduction rights (see Section 8). Please note that high-quality print reproductions of an original may be made available for separate purchase in the shop; however, the original hand-painted canvas itself remains singular and irreplaceable. Every original artwork:

● Is hand-painted by Keith Wahl personally;

● Is signed by the artist;

● A Certificate of Authenticity is available upon request at no additional charge — please note your request at the time of purchase or email theartist@keithwahlart.com after ordering; and

● Is strictly available as a single unit — once sold, it is no longer available for purchase (though its listing may remain visible as part of the Keith Wahl Art portfolio and archive);

Original artworks start from $20.00 USD. Prices vary by size, complexity, and subject matter.

2.4 Prints. Keith Wahl Art also offers high-quality art prints, which are reproductions of Keith's original paintings. Prints allow buyers to enjoy Keith's artwork at a more accessible price point and are produced to a high standard of color fidelity and durability. Prints do not include a Certificate of Authenticity and do not convey any ownership of the underlying original artwork. Prints start from $12.00 USD.

2.5 Custom Commissions. Keith accepts a limited number of custom commission requests, allowing buyers to request a one-of-a-kind, hand-painted piece tailored to their specifications. Commissions are hand-painted originals and are eligible for a Certificate of Authenticity upon request at no additional charge. The final commissioned artwork is created exclusively for the commissioning buyer. Keith Wahl Art will not produce or offer for sale prints, copies, or duplicates of the final commissioned work. This restriction does not prevent Keith Wahl Art from photographing or digitally documenting the artwork, including work-in-progress and completed-work images, or using those images for portfolio, documentation, and promotional purposes on the website. Completed commissioned work will be posted on the website in a sold items archive. Displaying these images does not make the commissioned original or reproductions of it available for purchase. Commissions start from $80.00 USD. See Section 4 for full commission terms.

2.6 Product Representation. Keith Wahl Art makes every effort to accurately represent colors, sizes, and details in product photographs and descriptions. However, due to variations in monitor calibration and screen settings, actual colors may vary slightly from what is displayed on your screen. Physical dimensions are stated in each product listing and should be reviewed carefully prior to purchase.

3. Ordering & Payment

3.1 Availability. All orders are subject to availability at the time of purchase. Because original artworks are one-of-a-kind, only a single unit of each original exists. Once an original is sold, it is no longer available for purchase. However, its listing may remain visible on the Site as part of Keith Wahl Art's portfolio and archive of completed works. Prints may be available in limited or ongoing quantities as noted in each listing.

3.2 Payment in Full. Full payment is required at the time of purchase for all orders, including prints and original artwork. For commissions, a non-refundable deposit is required upfront, with the remaining balance due prior to shipment (see Section 4).

3.3 Accepted Payment Methods. Keith Wahl Art processes payments through a secure checkout system. Accepted payment methods are displayed at checkout. All transactions are encrypted and handled through trusted third-party payment processors. Keith Wahl Art does not store your full payment card details on its servers.

3.4 Order Confirmation. Upon successful completion of your order, you will receive an order confirmation email to the address provided at checkout. This email confirms receipt of your order and payment. It does not constitute our acceptance of your order; Keith Wahl Art reserves the right to cancel or refuse any order after confirmation (see Section 3.5).

3.5 Right to Cancel or Refuse Orders. Keith Wahl Art reserves the right, at its sole discretion, to cancel, refuse, or limit any order for any reason, including but not limited to:

● Suspected fraudulent activity or unauthorized use of payment methods;

● Errors in product listings, descriptions, or pricing;

● Inability to verify payment or billing information;

● Orders that cannot be fulfilled due to unforeseen circumstances.

In the event an order is cancelled by Keith Wahl Art, a full refund of any payment received will be issued to the original payment method within a reasonable timeframe.

3.6 Pricing. All prices are listed in U.S. Dollars (USD) and are subject to change without notice. The price displayed at the time you complete your purchase is the price you will be charged. Sales tax may be applied where required by applicable law.

4. Commissions (Custom Orders)

4.1 Commission Process. To request a custom commission, buyers must complete and submit the Commission Application Form, available on the keithwahlart.com website. Commission requests submitted through any other method — including direct email — will not be accepted or reviewed. Your inquiry should include:

● A description of the desired artwork, including subject, theme, and any specific details;

● Reference images, if applicable (characters, compositions, style references); and

● Preferred size or format, if known.

Keith will review your request and respond with availability, pricing, and an estimated timeline. Submission of a commission inquiry does not guarantee acceptance.

4.2 Right to Decline. Keith Wahl reserves the right to decline any commission request at his sole discretion, for any reason, including but not limited to subject matter, scheduling conflicts, or artistic fit. No explanation is required for a declined request.

4.3 Commission Deposit. Upon acceptance of a commission request, a deposit will be required to reserve your slot and initiate work. The deposit amount will be confirmed in writing prior to payment. Commission deposits are non-refundable once work has commenced, to the extent permitted by applicable law. If you cancel a commission before work has begun, please contact theartist@keithwahlart.com as soon as possible — refunds in that scenario are considered on a case-by-case basis. If Keith Wahl Art is unable to complete a commissioned piece for any reason within its control, you will receive a full refund of all payments made toward that commission. Nothing in this clause is intended to affect any statutory rights you may have under applicable law.

4.4 Commission Slots. Commission availability is limited. Keith Wahl Art accepts a limited number of commission requests at any given time to ensure each piece receives the attention and quality it deserves. Slots are filled on a first-come, first-served basis upon deposit payment.

4.5 Timeline. Estimated completion timelines will be communicated at the time of commission approval. Timelines are estimates only and are not guaranteed. Factors such as complexity, size, and current workload may affect the timeline. Keith will communicate proactively if delays arise.

4.6 Communication & Progress. Keith will maintain reasonable communication throughout the commission process. Progress updates or work-in-progress photos may be shared at Keith's discretion. Buyers are encouraged to communicate any questions or concerns promptly via email.

4.7 Final Approval. Upon completion of the commissioned piece, Keith will share a photograph of the finished artwork for the buyer's review prior to shipping. The buyer will have a reasonable opportunity to request minor revisions consistent with the original agreed-upon scope. Significant changes to the original brief may be subject to additional charges. Once the buyer approves the final artwork — or once a reasonable review window has passed without response — the piece will be prepared for shipment.

4.8 Shipping Not Included in Commission Price. The commission price covers the creation of the artwork only. Shipping is not included in any commission quote or payment. Shipping costs will be calculated based on the size, weight, and destination of the finished piece, and will be charged separately to the buyer at the time of shipment or invoiced prior to shipping. Commission orders do not qualify for free shipping, regardless of the total commission price paid.

4.9 Commission Payments and Refund Exceptions. Once work begins, commission payments are subject to the deposit and refund provisions in Sections 4.3 and 6.3. If you cancel before work begins, refund requests are considered on a case-by-case basis. If Keith Wahl Art is unable to complete the commissioned piece for a reason within its control, you will receive a full refund of all payments made toward that commission. Nothing in this section limits any statutory rights you may have under applicable law.

5. Shipping & Delivery

5.1 Domestic Shipping. Keith Wahl Art ships to addresses within the United States. Free standard domestic shipping is available on eligible studio-shipped artwork for orders totaling $100 USD or more. Commissions and print-on-demand merchandise are excluded. Print-on-demand merchandise has separate shipping charges displayed at checkout, including when ordered together with eligible artwork. Applicable paid shipping options are also displayed at checkout. Regardless of the commission price, shipping costs for all commissioned pieces will be calculated separately and charged to the buyer at the time of shipment or invoiced prior to shipping.

5.2 Shipping Timeframes. Estimated delivery timeframes are provided for general guidance only and are not guaranteed. Delivery timelines may vary depending on your location, the shipping carrier, and current processing times. Keith Wahl Art will make reasonable efforts to ship orders in a timely manner after purchase or — in the case of commissions — after final approval.

5.3 Carrier Responsibility. Once an order has been handed off to the shipping carrier, Keith Wahl Art is not liable for carrier delays, lost packages, misdeliveries, or damage that occurs during transit, to the extent permitted by applicable law. Shipment tracking information will be provided where available. Nothing in this section is intended to affect any statutory rights you may have under applicable law. Customers with questions about their statutory rights are encouraged to seek independent legal advice. If you experience a shipping issue, we strongly encourage you to report it promptly — both to the carrier directly and to us at theartist@keithwahlart.com — so that we may assist you in filing a claim where applicable.

5.4 Risk of Loss. To the extent permitted by applicable law, risk of loss transfers to the buyer upon handoff of your package to the shipping carrier. Keith Wahl Art is not liable for carrier delays, losses, or damage occurring after that point, to the extent permitted by applicable law. Nothing in this section is intended to affect any statutory rights you may have under applicable law. Customers with questions about their statutory rights are encouraged to seek independent legal advice.

5.5 International Shipping. International shipping may be available for select destinations. If international shipping is offered for your location, it will appear as an option at checkout. International buyers are solely responsible for:

● All customs duties, import taxes, tariffs, and fees imposed by their country;

● Compliance with all applicable import laws and regulations; and

● Any delays caused by customs processing.

Keith Wahl Art is not responsible for packages held, delayed, or seized by customs authorities. International shipping fees, if applicable, will be displayed at checkout.

5.6 Address Accuracy. It is the buyer's responsibility to ensure that the shipping address provided at checkout is accurate and complete. Keith Wahl Art is not responsible for orders shipped to an incorrect address provided by the buyer.

6. Returns, Refunds & Exchanges

Important Notice

Due to the one-of-a-kind nature of original artwork, all sales of original paintings are final. Please review all product details, images, and dimensions carefully before purchasing.

6.1 Original Artwork — All Sales Final. Because each original painting is a unique, one-of-a-kind work that cannot be restocked, resold as new, or reproduced, all sales of original artwork are final, to the extent permitted by applicable law. No returns, exchanges, or refunds will be accepted for original paintings, including for reasons of buyer's remorse, change of mind, or dissatisfaction with subject matter that was accurately represented in the listing. Nothing in this clause is intended to affect any statutory rights you may have under applicable law. Customers who are uncertain about their statutory rights are encouraged to seek independent legal advice.

6.2 Prints — Damaged or Defective Items. If you receive a print that is damaged or defective upon arrival, you may be eligible for a return, exchange, or replacement. To initiate a claim:

● Contact Keith Wahl Art at theartist@keithwahlart.com within 15 days of delivery;

● Provide your order number and a clear description of the issue; and

● Include photographic evidence of the damage or defect, as well as photographs of the packaging if applicable.

Claims submitted outside of this window or without the required documentation may not be eligible for resolution. Returns due to buyer's remorse, change of preference, or reasons other than damage or defect are not accepted for prints. This reporting window and these return restrictions do not limit any statutory rights customers may have under applicable law.

6.3 Commissions — Deposit & Refund Policy. Commission deposits are non-refundable once work has commenced, to the extent permitted by applicable law. If you cancel a commission before work has begun, please contact theartist@keithwahlart.com as soon as possible — refunds in that scenario are considered on a case-by-case basis. If Keith Wahl Art is unable to complete a commissioned piece for any reason within its control, you will receive a full refund of all payments made toward that commission. Nothing in this clause is intended to affect any statutory rights you may have under applicable law.

6.4 Damaged Originals in Transit. In the rare event that an original painting is damaged during shipping, please contact us immediately at theartist@keithwahlart.com with photographs of the damage and packaging. To the extent permitted by applicable law, Keith Wahl Art is not liable for carrier delays, losses, or damage occurring after handoff to the shipping carrier. Nothing in this section is intended to affect any statutory rights you may have under applicable law. Customers with questions about their statutory rights are encouraged to seek independent legal advice. We will make every reasonable effort to assist you in filing a carrier claim and to find a fair resolution.

6.5 Refund Processing. Approved refunds, where applicable, will be issued to the original payment method used at checkout. Processing times may vary depending on your financial institution.

7. Certificate of Authenticity

7.1 Available Upon Request. A Certificate of Authenticity ("COA") is available for every original painting sold through keithwahlart.com, upon request and at no additional charge. The COA is issued and signed by Keith Wahl personally.

7.2 What the COA Verifies. The Certificate of Authenticity serves as written confirmation that the accompanying artwork is:

● An original, hand-painted work created personally by Keith Wahl;

● A one-of-a-kind hand-painted original (prints of this work may be available for purchase separately); and

● Authenticated by the artist's signature.

7.3 Retain Your Certificate. When requested before shipment, the Certificate of Authenticity accompanies the artwork. If requested after shipment, a digital Certificate of Authenticity will be provided by email at no extra charge. The certificate should be retained by the buyer as permanent documentation of the artwork's authenticity and provenance. Keith Wahl Art strongly recommends keeping the COA in a safe place alongside the artwork, as it may be relevant for future resale, insurance, or estate purposes.

7.4 Prints and Commissions. Certificates of Authenticity are available upon request for original paintings and completed commission pieces at no additional charge. Standard prints do not include a COA, as they are reproductions rather than unique originals.

8. Intellectual Property & Fan Art Disclaimer

8.1 Artist's Copyright. Keith Wahl is the sole creator and copyright owner of all original artwork he produces, including the creative expression, composition, and artistic execution of each piece. The sale of an artwork — whether an original, print, or commission — does not constitute a transfer of copyright or any other intellectual property rights to the buyer. Where Keith Wahl Art offers fan art or artwork depicting characters, franchises, or properties owned by third parties, Keith Wahl does not claim ownership of the underlying intellectual property. Such works are created as fan expressions and are not authorised, sponsored, or endorsed by the relevant IP holders. The sale of fan art or merchandise depicting third-party copyrighted characters or trademarks is subject to the rights of those IP holders. A fan art disclaimer does not itself constitute a licence to sell such works commercially. Keith Wahl Art assumes sole responsibility for any such listings offered through this Site.

8.2 What You Own. When you purchase an original painting or print from Keith Wahl Art, you are purchasing the physical object (or, in the case of prints, a printed reproduction). You do not acquire any right to:

● Reproduce, copy, scan, or digitally replicate the artwork;

● Create and sell prints or copies of the artwork;

● Distribute or display the artwork commercially without the artist's express written permission;

● Use the artwork in merchandise, advertising, or promotional materials; or

● Claim authorship or ownership of the artistic work.

8.3 Personal and Display Use. Buyers are permitted to display purchased physical artwork in their personal or business spaces, share photos of the artwork on personal social media for non-commercial purposes (with credit to Keith Wahl Art appreciated), and resell the original physical artwork as a collectible. Any other use requires prior written consent from Keith Wahl.

8.4 Fan Art Disclaimer. A portion of Keith Wahl's artwork features characters, themes, and imagery inspired by popular anime series, horror franchises, and comic book properties. These works are created as artistic expression and tribute to the source material. Keith Wahl Art expressly acknowledges that:

● The underlying characters, franchises, and intellectual properties depicted in fan art pieces are owned by their respective third-party rights holders (such as anime studios, comic book publishers, and entertainment companies);

● Keith Wahl does not claim ownership of any such underlying characters or franchises;

● Fan art pieces sold through this Site represent Keith Wahl's artistic interpretation and are offered as hand-painted originals or reproductions of Keith Wahl Art originals, as identified in each product listing. These works do not convey ownership of the underlying third-party intellectual property; and

● Purchasing a fan art piece does not grant any rights to the underlying characters or franchises depicted therein.

8.5 Site Content. All content on keithwahlart.com — including artwork images, photographs, text, logos, and design elements — is the property of Keith Wahl Art and may not be copied, reproduced, scraped, or used without express written permission.

9. Use of Website

9.1 Age Requirement. You must be at least 18 years of age to make a purchase on keithwahlart.com. If you are under 18, you may only use the Site and make purchases with the verifiable consent and involvement of a parent or legal guardian. By completing a purchase, you represent that you meet this requirement.

9.2 Permitted Use. You may use the Site for lawful, personal, non-commercial purposes — including browsing artwork, placing orders, and communicating with Keith Wahl Art — in accordance with these Terms.

9.3 Prohibited Activities. You agree that you will not:

● Place fraudulent orders or use stolen, unauthorized, or misrepresented payment information;

● Impersonate any person or entity or misrepresent your identity or affiliation;

● Use automated tools, bots, scrapers, or scripts to access, harvest, or copy any content from the Site;

● Reproduce, redistribute, or commercially exploit any artwork, images, or content from the Site without express written permission;

● Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems;

● Engage in any activity that violates applicable local, state, national, or international law or regulation; or

● Use the Site in any manner that could damage the reputation of Keith Wahl Art.

9.4 Account Security. If the Site offers user accounts, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Keith Wahl Art immediately at theartist@keithwahlart.com if you suspect unauthorized access to your account.

10. Limitation of Liability

10.1 No Indirect Damages. To the fullest extent permitted by applicable law, Keith Wahl Art — including Keith Wahl individually, his agents, and any affiliated parties — shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Site, your purchase of any product, or any other interaction with Keith Wahl Art. This includes, without limitation, loss of profits, loss of data, loss of goodwill, or emotional distress.

10.2 Cap on Liability. In no event shall Keith Wahl Art's total cumulative liability to you for any claim arising out of or relating to a specific transaction or product exceed the purchase price you actually paid for the item giving rise to that claim.

10.3 No Warranties Beyond Those Stated. Keith Wahl Art provides products and services "as described" and makes no warranties, express or implied, beyond those explicitly stated in these Terms. Keith Wahl Art specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by law.

10.4 Basis of Bargain. You acknowledge that the limitations set forth in this section are a fundamental element of the basis of the agreement between you and Keith Wahl Art, and that Keith Wahl Art would not be able to offer products and services at current price points without these limitations.

11. Privacy

11.1 Collection and Use. Keith Wahl Art collects certain personal information — such as your name, shipping address, email address, and payment details — during the checkout and ordering process. This information is used for the purposes of processing your order, fulfilling your purchase, communicating with you about your order, and providing customer support. In addition, Keith Wahl Art may use data in the following ways:

● We use analytics tools to understand site usage and improve the customer experience. Details about the information collected and available privacy choices are described in our Privacy Policy.

● Commission inquiry forms collect personal information (including name, email address, and project description) for the purpose of evaluating and responding to commission requests.

● Keith Wahl Art sends marketing or newsletter communications to customers who have opted in to receive them. Submitting a commission request does not automatically subscribe you to marketing. You may unsubscribe at any time using the link in our marketing emails or by contacting theartist@keithwahlart.com.

11.2 Third-Party Service Providers. We use third-party service providers to operate the store, process payments, produce and deliver orders, manage inquiries, and provide other services described in our Privacy Policy. Please refer to our Privacy Policy for details about disclosures of personal information and your available privacy choices.

11.3 Privacy Policy. For full details on how your data is collected, used, and protected, please refer to our Privacy Policy at keithwahlart.com. By using this Site, you also agree to the terms of the Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to These Terms

12.1 Right to Update. Keith Wahl Art reserves the right to modify, update, or revise these Terms of Service at any time, at its sole discretion. Changes may be made to reflect updates in business practices, applicable law, product offerings, or site functionality.

12.2 Notice of Changes. When changes are made, the updated Terms will be posted on this page with a revised "Last Updated" date. Keith Wahl Art may also notify users of material changes via email or a notice posted on the Site, though such notification is not guaranteed for all changes.

12.3 Continued Use as Acceptance. Your continued access to or use of keithwahlart.com after updated Terms have been posted constitutes your acceptance of those revised Terms. If you do not agree with any changes, you should discontinue use of the Site and refrain from placing further orders.

12.4 Review Periodically. We encourage you to review these Terms periodically to stay informed of any updates that may affect your rights or obligations as a buyer.

13. Governing Law & Dispute Resolution

13.1 Governing Law. These Terms of Service, and any dispute or claim arising out of or relating to them or your use of the Site or purchase of any product, shall be governed by and construed in accordance with the laws of the State of Nevada, United States of America, without regard to its conflict of law principles.

13.2 Jurisdiction and Venue. Any legal action, suit, or proceeding arising out of or relating to these Terms or any transaction with Keith Wahl Art shall be brought exclusively in the state or federal courts located in Clark County, Nevada.
